Does Apple Get Off Easier Than Microsoft?

Wi-Fi Sync Developer Accuses Apple of Ripping Him Off - Gizmodo:
"Of course I'm not absolving Apple from any wrongdoing. Even though they've imitated and adopted so many third party apps, it doesn't get less shitty each time. It's unfair for developers that Apple gets to 'be inspired' or 'rip off' their apps with no compensation. But it also comes with the territory of building third party apps for their platform. Can anyone seriously believe that the reaction to Microsoft doing this would be "oh well that is the risk of being a third party developer"? I can't see it but then maybe I am not paying close enough attention
